The following are the general terms and conditions that will apply if you decide to acquire The SuperChoice SMSF ESA Service. In these terms and conditions, you are referred to as the Client and we are referred to as SuperChoice.
SuperChoice will utilise a range of security measures to help ensure the security of SuperChoice including:
(a) Firewalls; and
(b) Data encryption (128 bit Secure Sockets Layer (SSL) protocol.
Client must ensure that it does the following in order to receive the services:
(a) Authorise and make payments for fees
(b) Comply with all applicable laws relating to your SMSF
(c) All material uploaded, displayed or transmitted by you in connection with your use of the Service will not be false, offensive, defamatory, threatening, obscene, unlawful or infringe any third party's rights (including without limitation their intellectual property rights).
SuperChoice may disclose Data.
(a) To relevant employees, its payment agent and to superannuation funds for the purposes of providing the services
(b) To legal advisers, auditors and other consultants of either party
(c) If it is required to disclose the information by law or a regulatory body or in connection with any legal proceedings.
The service is free to the SMSF Trustee for the period until June 30, 2017. During this time the Trustee is free to cancel or change to a different SuperStream ESA provider at any time. An invitation to continue to use the SuperChoice SMSF ESA, including a service fee will be issued prior to June 30, 2017.
The Policy applies to SuperChoice Services Pty Limited and its related company, Payclear Services Pty Limited (We, Us,Our).
We are committed to complying with the Privacy Act 1988 (Cth) ("Act") as amended from time to time. The requirements of the Act are set out in the Australian Privacy Principles ("APP"). The APP regulates, among other things, the collection, storage, quality, use and disclosure of personal information.
Any information that identifies an individual is considered to be "personal information"". We collect only information that is necessary for us to provide our products and services, and do not collect sensitive information as defined under the Privacy Act. The type of personal information we collect includes but is not limited to an individual's name, contact details, date of birth, Tax File Number, employer, name of the individual's superannuation fund and account number, salary and the amount and type of superannuation contribution. We collect similar information to recruit and manage the employment of our staff.
In most cases we receive personal information about an individual from our client, who is employing the individual or is the trustee or administrator of the individual's chosen superannuation fund. Where we have been provided with an individual's personal information by our clients we rely on them to obtain any requisite consent of the individual for collection, use and disclosure of this information to us.
We collect and use personal information to administer superannuation contributions and rollovers made on behalf of an individual. This information is supplied to us by our clients in compliance with relevant laws.
We do not use personal information for direct marketing, nor do we share, sell, rent or disclose your personal information. We may need to disclose the personal information to various persons or organisations in Australia. For example:
We rely on some of the exemptions permitted under the Privacy Act. For instance, the exemption for disclosing personal information to our related companies.
When browsing our website, our webservers automatically collect standard information as part of the HTTP web protocol - an IP address, browser type, operating system, access time, referring sites, pages viewed and other anonymous information. We analyse non-identifiable web traffic to improve our services.
We do not collect personal information about you if you only browse this website. This website only uses session cookies during a search query of the website. When you close your browser the session cookie is destroyed and no personal information is kept which might identify you to us in the future.
Our website may contain links to other sites operated by third parties. We are not responsible for the privacy practices or the content of such websites. We encourage the reading of the privacy statements in these linked sites, as their privacy policies may differ from ours.
We regard the security of personal information as very important. We take reasonable steps to protect the information we hold and have a number of physical and electronic protection measures in place. This includes encryption, firewalls, site monitoring, intrusion detection and video surveillance.
The security arrangements are reviewed and tested from time to time.
We restrict access to personal information solely to employees who need to access this information to complete tasks relating to the efficient and effective processing of superannuation contributions.
Employees are subject to a Code of Conduct which includes a commitment to maintain confidentiality of personal information.
Personal information is stored in our database and archived for a period yet to be determined, but this is likely to be a minimum of 7 years. No information is stored or processed outside Australia.
In some circumstances clients (employers) may request access to information we hold about them or their employees. Trustees may request information we hold about them, their sponsoring employers and those employer's employees. Clients may also ask us to correct information we hold if it is inaccurate, incomplete, misleading or out-of-date.
Individuals should contact their employer or fund Trustee or Administrator if they wish to access or correct their personal information, as we will only accept corrections from our clients.
Individuals may deal with us anonymously but will only receive general information. We may charge a fee if access is provided, and may refuse access if the privacy legislation allows us to do so. Individuals on email lists for administrative or other purposes may opt out of further contact by advising us.
